    A Florida woman is arguing that she should be released from jail pending her murder trial because the detention is harming her unborn baby.

    Natalia Harrell, 24, was six weeks pregnant when she shot and killed Gladys Yvette Borcela, 28 in Miami in July last year.

    The pair had been at a bar with a group of men and left in an Uber. As they were driving from South Beach through the Brickell neighborhood of the city, the women got involved in an argument, and Harrell pulled out a gun, shooting Borcela dead.

    On Thursday, Harrell's lawyer argued in court documents that detaining Harrell's unborn child at Turner Guilford Knight Correctional Center in Miami was unfair.

    'UNBORN CHILD has not been charged with any crime by the State,' the writ of habeas corpus said. 'Further, the State has placed the UNBORN CHILD in such inherently dangerous environment by placing the UNBORN CHILD in close proximity to violent criminal offenders.'

      Can’t fault her for trying, but to find a lawyer that was willing to make a complete clown out of themselves couldn’t have been easy.

        Knowing America and their obsession with the rights of foetuses, this will stick and women will purposely begin to get pregnant so they can murder their enemies and get away with it.

            It stinks of ‘a job is a job’ but I’m intrigued, I won’t lie.

            If an unborn child has legal rights and protection from their mother’s choices (abortion) then an unborn child should not be forcibly endangered as a result of their mother’s choices either.

            They will presumably need to demonstrate that there is a significant risk to life, and potentially have to back that up with statistics of prison miscarriages I guess.

            It doesn’t mean the mother goes free, but a prison must be obliged to provide a safe environment for expectant mothers, so it’ll be interesting to see how they argue prisons are safe (assuming it gets that far).
            I have a bad feeling about this.

                    In hindsight I’m almost disappointed that no one thought of this argument against extreme pro-life supporters. Or maybe someone did and that’s where she got the idea from.

                        I would support the mother being transferred to a prison maternity ward and once delivered her baby be safely transported out of prison. The sad part which we can never change is the imprisoned mother and her crime.

                          I mean she could be paroled until the baby is born (which is within weeks going by the pregnancy dates) and then she could just go back in after? I don’t see the big deal tbh!

                          Is it any different to Elizabeth Holmes being given time until her baby was born before she surrenders herself? (Very different crimes obviously)

                            Btw, can I just mention how shocking it is that people get shot dead over random arguments? I know it’s nothing new, but I find it just as noteworthy as that pregnancy discussion.
